สิทธิบัตร “ฝนหลวง” l The “Royal Rain” Patent นายอ��ำพล เสนาณรงค์ องคมนตรี ซึ่งเป็นผู้แทนพระองค์ในการด��ำเนินการจดทะเบียนสิทธิบัตรฝนหลวง น��ำ คณะซึ่งประกอบด้วยคณะท��ำงานในโครงการด��ำเนินการจดทะเบียนสิทธิบัตร ถวายพระบาทสมเด็จ พระเจ้าอยู่หัว และคณะท��ำงานจัดท��ำจดหมายเหตุ สิทธิบัตรฝนหลวง เข้าเฝ้าฯ ณ วังไกลกังวล เพื่อ ทูลเกล้าฯ ถวายสิทธิบัตรฝนหลวง / Mr. Ampon Senanarong, the Privy Councilor, acting on his behalf in having the Royal Rain Patent registered, led a team made up of project researchers and registered the patent for His Majesty the King and the team and subsequently presented a memorandum for an audience with His Majesty at the Klai Kangwon Palace. His Majesty King Bhumibol Adulyadej, in his magnanimous mercy, had a patent issued by the National Research Council of Thailand in cooperation with various other relevant agencies under the name of “Weather Modification for Rain Production.” As a result, the patent was issued on November 29, 2002 and presented to him on June 2, 2003 and His Majesty had the King’s Royal Rain Patent proposed for registration to the European Patent Office (EPO) and patent offices of other countries under the title “Weather Modification by Royal Rainmaking Technology.” The EPO promulgated this patent on October 12, 2005. The patent rights cover 30 countries of the European Union and another 10 countries had patents issued for their own count ries separately: Cyprus, Denmark, France, Morocco, Romania, Turkey, Albania, Lithuania, Macedonia and Greece. For the patent issued by the Patent Office of the Hong Kong Special Administrative Region, rights coverage was also extended from the EPO patent. On this occasion, the king talked about cooperation from the heart in working to develop the country: “…I have long been aware that to make progress is not an easy matter. In most cases, to make progress, it takes knowledgeable people and people with capital. We have no capital but, if we are capable, we should work assiduously, put the knowledge of each other for use, that of the Ministry of Agriculture and Cooperatives, the Ministry of Interior and other ministries, then the people should cooperate without thinking about taking advantage of one another. This is most important. I believe that this will make the nation progress well. This will make it possible for the nation to be well developed, especially these days when it is facing a hard time. We don’t know where to go, or how to get there but, after this visit, I can tell you that the nation is not facing such a hard time. I worried that Thailand was about to sink but it has been well developed. The nation has progressed, the people have progressed. I have hope. I feel that the nation is not going to sink. Until now, I felt that our nation was sinking because each party was doing things its own way; each was contending; each did not understand what was being done because each was doing something different. With knowledgeable people like you, who have cooperated, who are people with different kinds of knowledge, I assert that if all the people contribute their knowledge and goodwill, then they are capable of building a nation heading towards glory. Indeed, I exhort you all to contribute your efforts.” This came from a speech given on the occasion that His Majesty King Bhumibol Adulyadej permitted Mr. Ampon Senanarong the Privy Councilor, to usher Secretary-General of the National Research Council of Thailand Anont Bunyarattavej and his team to have an audience with His Majesty to present him with the Royal Rain Patent August 21, 2009 at the Piamsuk Villa of the Klai Kangwon Palace, Hua Hin district, Prachuabkirikhan province. สืบเนื่องจากพระบาทสมเด็จพระเจ้าอยู่หัว ทรงพระกรุณาโปรดเกล้าโปรด กระหม่อม ให้ด��ำเนินการขอรับสิทธิบัตรในพระปรมาภิไธย โดยมีส��ำนักงาน คณะกรรมการวิจัยแห่งชาติ กับหน่วยงานที่เกี่ยวข้องร่วมด��ำเนินการ ภายใต้ชื่อ “การดัดแปรสภาพอากาศให้เกิดฝน” จนได้ออกสิทธิบัตรดังกล่าว เมื่อวันที่ 29 พฤศจิกายน 2545 และโปรดเกล้าฯ ให้น��ำขึ้นทูลเกล้าฯ ถวาย เมื่อวันที่ 2 มิถุนายน 2546 และได้ยื่นขอจดทะเบียนสิทธิบัตรฝนหลวงใน พระปรมาภิไธย ต่อส��ำนักงานสิทธิบัตรยุโรปและประเทศต่างๆ ในชื่อ “Weather Modification by Royal Rainmaking Technology” ซึ่งส��ำนักงานสิทธิบัตรยุโรป ทูลเกล้าทูลกระหม่อมถวายสิทธิบัตรนี้ ในวันที่ 12 ตุลาคม 2548 โดยสิทธิบัตรดังกล่าว มีผลคุ้มครองครอบคลุมประเทศ ต่างๆ ในกลุ่มสหภาพยุโรป จ��ำนวน 30 ประเทศ และมี 10 ประเทศ ที่ออกเป็นสิทธิบัตรแยกแต่ละประเทศ ได้แก่ ไซปรัส เดนมาร์ก ฝรั่งเศส โมร็อกโก โรมาเนีย ตุรกี แอลเบเนีย ลิธัวเนีย มาซิโดเนีย กรีซ ส��ำหรับ สิทธิบัตรที่ออกโดยส��ำนักสิทธิบัตรเขตบริหารพิเศษฮ่องกง ได้รับการขยาย ความคุ้มครองมาจากสิทธิบัตรของส��ำนักงานสิทธิบัตรยุโรปเช่นกัน โอกาสนี้มี พระราชด��ำรัสถึงความร่วมมือร่วมใจกันท��ำงานเพื่อพัฒนาประเทศ “...ข้าพเจ้าได้เห็นมานานแล้วว่า การท��ำความก้าวหน้านั้นไม่ใช่ง่ายๆ โดย มากถ้าท��ำความก้าวหน้าต้องมีคนที่มีความรู้ มีคนที่มีทุน เราไม่มีทุนอะไร แต่ ถ้าท��ำได้ ตั้งใจท��ำ เอาความรู้แต่ละคนน��ำมาใช้ ทางกระทรวงเกษตรและ สหกรณ์ ทางกระทรวงมหาดไทย ทางกระทรวงอื่นๆ ทางประชาชนมา ร่วมมือกันโดยไม่นึกเอาเปรียบกัน อันนี้ส��ำคัญที่สุด เชื่อว่า จะท��ำให้บ้านเมือง ก้าวหน้าดี บ้านเมืองจะสามารถพัฒนาขึ้นมาดี โดยเฉพาะระยะนี้ บ้านเมือง กíำลังยุ่ง ไม่รู้จะไปไหน ไปอย่างไร แต่ว่าไปดูที่นั่น บอกได้ว่า บ้านเมืองไม่ ยุ่ง เราก็รู้สึกเป็นห่วงว่า ประเทศไทยก��ำลังจม แต่ว่ามีการพัฒนาอย่างดี บ้านเมืองก้าวหน้า และประชาชนมีความเจริญ เรามีความหวัง มีความรู้สึก ว่าบ้านเมืองจะไม่ล่มจม ซึ่งเมื่อระยะเวลาที่ผ่านมา รู้สึกว่า บ้านเมืองของเรา ก��ำลังล่มจม เพราะว่าต่างคนต่างท��ำ ต่างคนต่างแย่งกัน ต่างคนต่างไม่เข้าใจ ว่าท��ำอะไร เพราะทุกคนก��ำลังท��ำ อาศัยผู้ที่มีความรู้อย่างท่านทั้งหลายที่ได้มา ร่วมมือกัน มีความรู้ต่างกัน ขอยืนยันว่า ถ้าทุกคนที่มีความรู้ มีความตั้งใจดี สามารถที่จะสร้างบ้านเมืองให้เจริญโดยแท้จริง ขอให้ท่านช่วยกันท��ำ...” พระราชด��ำรัส เนื่องในวโรกาสพระราชทานให้ นายอ��ำพล เสนาณรงค์ องคมนตรี น��ำ นายอานนท์ บุณยะรัตเวช เลขาธิการคณะกรรมการวิจัยแห่งชาติ และคณะ เฝ้าทูลละอองธุลีพระบาททูลเกล้าทูลกระหม่อมถวายสิทธิบัตร ฝนหลวง เมื่อวันที่ 21 สิงหาคม 2552 ณ พระต��ำหนักเปี่ยมสุข วังไกลกังวล อ��ำเภอหัวหิน จังหวัดประจวบคีรีขันธ์ วารสารอุทยานสิ่งแวดล้อมนานาชาติสิรินธร Journal of the Sirindhorn International Environmental Park 9
